Terms of Use

By using this site, you confirm you are at least 18 years old and have the authority to submit leads and enter into a partner relationship, either individually or on behalf of the company or LLC you represent.

SellMyLeads is a lead-provider program operated by CloseCenter. It allows real estate investors, wholesalers, and other participants ("Partners") to submit residential seller leads through a partner account. CloseCenter contacts and qualifies submitted leads and, where appropriate, places them with a licensed real estate agent in its network. CloseCenter pays Partners a flat fee of one hundred twenty dollars ($120) for each submitted lead that CloseCenter places with an agent ("Lead Fee"). The Lead Fee is a fixed payment for the delivery of a validated lead. It is not a commission, is not calculated from any property value or transaction, is not a share of any fee CloseCenter may receive from an agent, and is not contingent on any listing, contract, or closing.

These Terms of Use govern your use of the website only. They are not, by themselves, a payment agreement. No Lead Fee is earned or owed unless (a) you and CloseCenter have executed a separate signed Partner Agreement, (b) CloseCenter has a completed IRS Form W-9 from you on file, and (c) a lead you submitted through your partner account has been placed by CloseCenter with an agent in its network. Lead Fees earned during a calendar month are paid by check in the following month to the payee name and mailing address in your partner account. Duplicate submissions, submissions containing false or unreachable contact information, and submissions for sellers who did not agree to be contacted do not earn a Lead Fee. CloseCenter reserves discretion to decline to work any submitted lead.

By submitting a lead, you represent that: you have a good-faith basis to believe the information you're submitting is accurate; you are not violating any law, regulation, or third party's rights (including Do Not Call and consent requirements) by submitting it; and you grant CloseCenter a license to use the information you submit to contact, qualify, and refer the lead. CloseCenter may decline, disqualify, or stop working any lead at any time.

You may not submit fraudulent, duplicate, or knowingly false leads; submit any person who has not agreed to be contacted by CloseCenter; submit a property you are under contract to purchase; or misuse the site. Partners are lead providers only. You may not negotiate, discuss price or terms, make any representation on CloseCenter's behalf, or otherwise hold yourself out as acting for CloseCenter or any agent in its network. Violation of this section results in termination of your partner account and forfeiture of any unpaid Lead Fees for the affected submissions.

Participating in this program does not create a real estate brokerage, agency, employment, joint venture, or partnership relationship between you and CloseCenter. Partners are independent contractors. You are responsible for your own taxes; CloseCenter will issue IRS Form 1099-NEC where required by law. You remain responsible for complying with all real estate licensing laws that apply to you.

This site and the SellMyLeads program are provided "as is," without warranties of any kind, express or implied, including as to the accuracy of information on the site or the outcome of any referral.

To the fullest extent permitted by law, CloseCenter is not liable for indirect, incidental, or consequential damages arising from your use of this site or participation in the SellMyLeads program. CloseCenter's total liability for any claim arising from this program is limited to the referral compensation actually owed to you under a signed Partner Agreement, if any.

You agree to indemnify and hold CloseCenter harmless from claims arising out of your breach of these Terms or your submission of inaccurate or unauthorized information.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

CloseCenter may suspend or end a Partner's participation in this program at any time, for any reason, subject to the terms of any signed Partner Agreement.
